California OTs need separate board approval before providing hand therapy, physical agent modalities or swallowing services. Hand therapy takes 45 contact hours and 480 supervised hours; modalities take 30 and 240; swallowing takes 45 and 240. Hours must fall within the prior five years. CHT certification satisfies hand therapy and modalities, not swallowing.
In California, an occupational therapist may not provide hand therapy, use physical agent modalities, or perform swallowing assessment, evaluation or intervention until the California Board of Occupational Therapy approves them in that specific area. A California license alone does not cover these services. Each approval requires post-professional coursework plus supervised training completed within the five years before you apply, documented on the board's own form. Certified Hand Therapists meet the requirements for hand therapy and modalities, but still have to apply.
Where does the requirement come from?
California's practice act lists three advanced practices that require board approval: "(1) Hand therapy. (2) The use of physical agent modalities. (3) Swallowing assessment, evaluation, or intervention" (Bus. & Prof. Code § 2570.3). The details are in Article 6 of the board's regulations, Title 16 of the California Code of Regulations, sections 4150 through 4155. Section 4155 states the rule plainly: to provide any of these services, an occupational therapist "shall apply to the Board and receive approval."
The statute and regulations are written for occupational therapists: section 4155 begins "an occupational therapist shall apply." If you are an OTA, ask the board how these rules apply to your role before you take on any of these services.
Which hours does each area require?
Hand therapy (16 CCR § 4151)
- Education: 45 contact hours in the subjects listed in Bus. & Prof. Code § 2570.3(e), including 30 hours specifically on the hand, wrist and forearm.
- Training: 480 hours of supervised on-the-job training, clinical internship or affiliation, paid or voluntary, pertaining to hand therapy.
- Alternative: Current certification as a Certified Hand Therapist from the Hand Therapy Certification Commission.
- Overlap: If you use modalities in hand therapy, you must also meet section 4152, and up to 8 contact hours and 60 supervised hours can count toward both.
Physical agent modalities (16 CCR § 4152)
- Education: 30 contact hours in the subjects listed in § 2570.3(f).
- Training: 240 hours of supervised training pertaining to physical agent modalities.
- Alternative: Current CHT certification satisfies both.
- Limit: You may use only the modalities you are competent to use.
Swallowing assessment, evaluation or intervention (16 CCR § 4153)
- Education: 45 contact hours covering anatomy, physiology and neurophysiology of the head and neck; the effect of pathology on the aerodigestive tract, including medical interventions and nutritional intake methods; and interventions to improve pharyngeal swallowing.
- Training: 240 hours of supervised training pertaining to swallowing.
- Scope: In instrumental evaluations, the OT's role is to observe the structure and function of the swallowing mechanism. The OT "may not perform the physically invasive components of the instrumental evaluation."
- No CHT shortcut: The regulation offers no certification alternative for swallowing.
Does topical medication use need its own approval?
It is tied to modalities. Section 4152.1 lets an OT apply certain topical medications (bacteriocidal, debriding, topical anesthetic, anti-inflammatory, antispasmodic and adrenocortico-steroid agents) when ordered by an authorized prescriber and under written facility protocols. When the medication is applied with a physical agent modality the OT must be approved in physical agent modalities. The regulation also says it never authorizes an OT or OTA to administer medication by injection.
Which coursework and supervisors count?
Section 4154 governs the training. Key rules:
- Five-year lookback. Coursework and training "must be completed within the five years immediately preceding the application for approval in each advanced practice area." An OT who did a modalities course in 2019 and hand therapy training in 2020 may need fresh hours.
- Acceptable education sources include ACOTE-accredited programs, programs approved by the physical therapy and speech-language pathology accrediting bodies, board-approved providers, and other providers if you can show the course meets the subject requirements with detailed content and instructor information.
- Supervisors must have a written, signed agreement with you before the training begins, be readily available in person or by telecommunication during the services, have no conflict of interest that would compromise objectivity, and, if they are health care practitioners, hold an active, unrestricted license.
While you are completing training, the statute allows you to practice the advanced area under the supervision of an OT who already meets the requirements (Bus. & Prof. Code § 2570.3(g)). For swallowing, section 4153 also allows supervision by a speech-language pathologist with expertise in the area or by a physician and surgeon.
How do you apply?
Each area has its own form, all revised in October 2022 per section 4155: Form APH for hand therapy, Form APP for physical agent modalities and Form APS for swallowing. Each application needs:
- Course completion certificates or transcripts.
- For courses not from a board-approved provider: contact hour verification, the course outline or syllabus, a description of how the content relates to the practice area, and instructor credentials.
- Verification of the supervised training, signed under penalty of perjury.
Section 4155 adds that an application not completed within six months of receipt is considered abandoned, and you have to start over with a new application.
Which applications run into trouble?
- Old hours. The five-year rule is the most common problem for experienced OTs moving to California.
- Undocumented training. Supervisors who have left the employer, retired or cannot be reached make the signed verification hard to obtain. Start collecting signatures early.
- Courses without syllabi. Non-approved courses need outlines and instructor credentials. Many older certificates show only a title and hours.
- Assuming a CHT covers swallowing. It does not.
- Starting the job before approval. A clinic may assign hand or modality work immediately. Without approval, you are limited to supervised practice while in training.
Do other states have similar rules?
Several states regulate modalities separately. Tennessee requires certification to use electrical stimulation and thermal agents, with 25 and 20 contact hours of board-approved training respectively, or current CHT certification (Tenn. Comp. R. & Regs. 1150-02-.04(4)). Georgia's rules refer to physical agent modality certification as well. Our post on physical agent modality rules by state compares them, and licensing questions for hand therapists and dysphagia credentials for OTs cover those specialties.
Can we assemble your approval packet?
Yes. Our California Advanced Practice Approval service is $349 per area. We audit your courses and training against the five-year rule and the subject lists, request syllabi and supervisor verifications, identify any gaps, prepare the form, and track the board's review. You sign the attestations, and the board decides. If you also need the California license itself, see getting a California OT license from another state and our California requirements page.
Common questions
- Does my CHT certification let me do hand therapy in California?
- It satisfies the education and training requirements for hand therapy and physical agent modalities, but you still must apply to the board and receive approval in each area.
- How recent do my courses and training hours have to be?
- Within the five years immediately preceding your application for approval in each area, under 16 CCR section 4154.
- Can I do swallowing work while I complete the training hours?
- Yes, under the supervision of an OT approved in swallowing, a speech-language pathologist with expertise in the area, or a physician and surgeon.
- What happens if my approval application is incomplete?
- Under section 4155, an application not completed within six months of receipt is considered abandoned, and you must submit a new one.
